Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website and services provided by EWP Certification Australia Pty Ltd ("EWP Certification Australia", "we", "us" or "our"). By accessing our website, requesting a quote, booking an inspection, or engaging our services, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use our website or services.

2. Our services

We provide independent engineering inspection, testing, and certification services for elevated work platforms, cranes, access equipment and related heavy machinery. We are an independent consultancy — we do not sell or repair equipment, and our role is limited to objective assessment and certification against applicable Australian Standards and statutory requirements.

Any quote we provide is an estimate based on the information supplied to you and may be revised if the scope, equipment condition or site conditions differ from what was described.

3. Bookings and quotes

When you submit a booking, quote or contact request, you agree to provide accurate, current and complete information. You are responsible for ensuring that equipment is available, accessible and safe to inspect at the agreed time and location. We reserve the right to reschedule or decline an inspection where access, safety or site conditions are inadequate.

4. Your content and uploads

Our forms allow you to upload photos, documents, service records and other materials. By submitting content to us, you confirm that:

  • You own the content or have the right to share it with us.
  • The content does not infringe the rights of any third party or breach any law.
  • You grant us permission to use the content for the purpose of assessing equipment, preparing reports and delivering our services.

We handle uploaded content in accordance with our Privacy Policy. Do not upload sensitive personal information unless it is necessary for the service.

5. Certification and reports

Any certificate, report or compliance document we issue reflects the condition of the equipment and the information available at the time of inspection. Certification does not guarantee ongoing compliance where equipment is subsequently modified, damaged, misused or not maintained. You remain responsible for the safe operation, maintenance and lawful use of your equipment at all times.

6. Fees and payment

Fees for our services are as set out in the applicable quote or agreement. Unless otherwise agreed in writing, invoices are payable by the due date stated on the invoice. We may withhold reports or certification until payment has been received in full.

7. Limitation of liability

Our services are provided with due care and skill and in accordance with applicable professional standards. To the maximum extent permitted by law, and subject to any rights you have under the Australian Consumer Law that cannot be excluded, our liability arising from or in connection with our services is limited to re-supplying the relevant service or paying the cost of having it re-supplied.

We are not liable for any loss or damage arising from inaccurate information provided to us, or from the operation, maintenance or condition of equipment outside the scope or time of our inspection.

8. Intellectual property

All content on this website, including text, graphics, logos and layout, is owned by or licensed to us and is protected by intellectual property laws. You may not reproduce, distribute or exploit any part of the website without our prior written permission. Reports and certificates we issue may be used for their intended compliance purpose but must not be altered or presented in a misleading way.

9. Third-party links

Our website may contain links to third-party websites. We provide these links for convenience only and are not responsible for the content, products or practices of any third-party site.

10. Governing law

These Terms are governed by the laws of the State of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
